RISK OF LOSS

All items purchased from Meenakshi Balaji Arts are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

PRODUCT DESCRIPTIONS

Meenakshi Balaji Arts and its affiliates attempt to be as accurate as possible. However, Meenakshi Balaji Arts does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Meenakshi Balaji Arts itself is not as described, your sole remedy is to return it in unused condition.

PRICING

Except where noted otherwise, the List Price displayed for products on our website, whether in Foreign Currency or Indian Rupees represents the full price of the product.

With respect to items sold on Meenakshi Balaji Arts, we charge your credit card before your order has entered the shipping process. For any reason if we are not able to ship you products as per your order, we will intimate you electronically and refund the value of the products not available. Any additional Shipping Fees, if applicable, will not be refunded.

Despite our best efforts, a small number of the items in our catalog may be mispriced. If we discover a mispricing, we will do one of the following:

If an item correct price is lower than our stated price, we will charge the lower amount and ship you the item.

If an item correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.

Please note that this policy applies only to products sold and shipped by Meenakshi Balaji Arts.

The prices displayed on this site are quoted in Indian Rupees with approx. conversion rate in US Dollars. The actual amount to be paid by you will be the equivalent amount in the currency of your credit card, as per the conversions done by your bank / credit card provider on the date of billing.

DUTIES AND TAXES

All orders are shipped internationally from our warehouse in Chennai, India to your provided shipping address. Due to the nature of international shipping, occasionally a customer may have to pay additional import duties and taxes which are levied once a shipment reaches your country. The large majority of orders will not have to pay any additional fees. However, we are unable to calculate when and how much these infrequent customs duty charges will be levied. In the case where additional customs charges are assessed, you will be responsible for paying these additional fees. Meenakshi Balaji Arts takes no responsibility for non-delivery of orders in case such taxes and duties are not accepted and settled by the recipient at the delivery address and will not provide any refunds in such cases.

PRODUCT PROPERTIES AND WASH CARE

All of Meenakshi Balaji Arts products are handcrafted using the finest natural elements. The subtle variations in color, texture and finish are intrinsic to hand made products. Our products involve crafts-based traditions of hand spinning, dying, weaving, wood block printing and embroidery. We use both vegetable dyes and commercial dyes with the goal of minimizing our impact on the environment while striving for the best color properties. An irregular weave or print is not a defect - handloom by definition means uncertainty when it comes to uniformity.

This site is provided by Meenakshi Balaji Arts on an as is and as available basis. Meenakshi Balaji Arts makes no representations or warranties of any kind express or implied, as to the operation of this site or the information, content, materials, or products included on this site. You expressly agree that your use of this site is at your sole risk.

To the full extent permissible by applicable law, Meenakshi Balaji Arts disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Meenakshi Balaji Arts does not warrant that this site, its servers, or e-mail sent from Meenakshi Balaji Arts are free of viruses or other harmful components. By visiting Meenakshi Balaji Arts, you agree that the laws of India, under the jurisdiction of the Mumbai High Court, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Meenakshi Balaji Arts or its affiliates.

DISPUTES

Any dispute relating in any way to your visit to Meenakshi Balaji Arts or to products you purchase through Meenakshi Balaji Arts shall be submitted to confidential arbitration in New Delhi, India, except that, to the extent you have in any manner violated or threatened to violate Meenakshi Balaji Arts intellectual property rights, Meenakshi Balaji Arts may seek injunctive or other appropriate relief in any court in India or internationally, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing under the Indian Arbitration Act. The arbitrator award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

Site policies, modification, and severability Please review our other policies, such as our pricing policy, posted on this site. These policies also govern your visit to Meenakshi Balaji Arts. We reserve the right to make changes to our site, policies, and these Terms of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

"We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.
